The start of a new year is a great time to make sure your affairs are up-to-date.

If you’ve experienced life changes such as marriage, retirement, purchasing a property, birth of a child - there's never been a better time to update your Will.

While you are taking the time to update your Will, also consider your Enduring Power of Attorney. An Enduring Power of Attorney protects you should the unforseen happen and you lose capacity to make your own decisions.

An Enduring Power of Attorney and Will should form part of every adult Queenslander’s future planning.

Minors Trusts

If you have a child, grandchild, niece or nephew aged under 18 you can make provision for them in your Will by setting up a minors trust.

You can specify how much money you would like to give them, if money is to be granted yearly for living and educational expenses and if the child is to receive the benefit at an age later than 18.

Enduring Powers of Attorney

An Enduring Power of Attorney is a legal document that outlines who you would like to manage your affairs; such as when you no longer have capacity to do so.

People can lose capacity for reasons such as intellectual or psychiatric disability, acquired brain injury, dementia or temporary illness. A loss of capacity can happen at any time, at any age and this loss may be temporary or permanent.

Who should make an Enduring Power of Attorney?

If you are over 18 and have the capacity to understand the nature and the effect of the power you are granting to an Attorney, you can plan for your future with an Enduring Power of Attorney.
